Texas Motor Speedway – “2022 GEARWRENCH NASCAR All-Star Race Contest” Official Rules

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE YOUR CHANCES OF WINNING.

ELIGIBILITY: Open to legal residents of the United States except legal residents of the states of California, Connecticut, Massachusetts, New Jersey and New York and who are 18 years of age or older. Void where prohibited. Employees, officers, and directors of Texas Motor Speedway, LLC, Speedway Motorsports, LLC, Apex Tool Group, LLC and their respective divisions, affiliates, subsidiaries and agents, and any others engaged in the development, production or distribution of promotional materials or prizes for this contest, and members of the immediate families or households of any of the above are not eligible to enter or win. This contest is subject to all applicable federal, state and local laws and regulations. Void where prohibited.

HOW TO PLAY: Between Wednesday, April 13, 2022 at 8 a.m. CDT and Sunday, May 15, 2022 at 11:59 p.m. CDT go to http://www.texasmotorspeedway.com/gearwrench and complete all required registration fields including: email address, first name, last name, phone number, zip code and also answer the following questions: do you own hand tools, what type of hand tools do you own, what brand of tools did you purchase, and where did you purchase these hand tools to be deemed a valid entry.

Limit one valid entry per person for the contest. Contest winners will be selected on or about Monday, May 16, 2022.

WINNER SELECTION:

• The Grand Prize Winner will be selected on or about Monday, May 16, 2022.

• One (1) Grand Prize Winner will be randomly selected from all valid entries received.

• To be deemed the Official Grand Prize Winner:

o The potential prize winner will be contacted at the email address provided via their valid entry on or about Monday, May 16, 2022.

o The potential prize winner will be instructed to respond to the email and are required to sign and return an affidavit of eligibility and publicity/liability release along with a copy of their state issued valid driver’s license and completed W-9 within 24 hours.

o A second attempt will be made to contact the prize winner via email, and they will again be instructed to respond to the email and are required to sign and return an affidavit of eligibility and publicity/liability release along with a copy of their valid driver’s license and completed W-9 within 24 hours.

o If the potential prize winner is determined to be ineligible or fails to return the completed paperwork within the second 24-hour time period, they will forfeit the prize.

o If the prize winner fails to respond to the email, they forfeit their potential prize and no other potential prize winners will be selected.

Total ARV of prizes: $1,748

All prize details not specified herein shall be at Administrator’s discretion. No prize substitutions, transfers or cash alternatives permitted, except Administrator reserves the right to substitute a prize of equal or greater value if the advertised prize becomes unavailable. All decisions of the Administrator are final in all matters relating to this Contest.

Each prize winner is solely responsible for any expenses in connection with the prize not expressly described herein as being awarded including, without limitation, all taxes, including but not limited to federal, state, and local.

Sponsor, Administrator and their respective parent companies, divisions, affiliates and subsidiaries, and each of their directors, officers, employees, agents, representatives, successors and assigns, and all others associated with the development and execution of this contest, including, without limitation, the prize providers, are not responsible for: printing or other errors; mechanical errors; inaccurate, fraudulent, incomplete, illegible, late, lost, stolen, misdirected or damaged entries; or any delays in delivery of prize; or bodily injuries, death, losses or damages of any kind, without limitation, that may arise from or in connection with entrants’ participation in this contest or acceptance, possession or use of the prizes, or participation in prize-related activities. Administrator reserves the right at its sole discretion to disqualify: any entries submitted fraudulently, the entries of any entrant that tampers with the operation of the Contest or any entrant who otherwise violates the Official Rules of the Contest. If, for any reason, the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Administrator which corrupt or affect the

administration, security, fairness, integrity or proper conduct of the Contest, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest and select winners from eligible entries received prior to the date of termination or suspension. By accepting any prize, the winner agrees that the Sponsor and its designees may use his/her name, voice, photograph, likeness, address (city and state), biographical information, prize information and/or statements about this Contest for advertising and publicity purposes in all media worldwide at the discretion of the Sponsor without limitation, further compensation or notice. Sponsor reserves the right to share the legitimate entries with third party affiliates, vendors or partners at their sole discretion.

Subject to the laws of the State of Texas. Any and all actions or disputes regarding this offer shall be exclusively brought in the District Courts of Denton County, Texas.
